SLAPP Down


A lawsuit intended to punish a Marconi Point couple who complained to public agencies about actions of a developer appears to have been the first legal test of Hawai`i’s new law providing protections against such Strategic Lawsuits against Public Participation (SLAPP) suits.

And it seems to have worked as intended.

The SLAPP litigation is just one of many of the legal facets associated with the Marconi Point development, where endangered species habitat has been destroyed, protected albatross harassed and even killed, and Conservation lands denuded.

Also in this issue, we review some of the long- stalled Land Use Commission dockets, where the promise of housing is largely unfulfilled.
