ISLAND WATCH : Supreme Court Says Maui Erred In SMA Permit to Napilihau Project The Hawai’i Supreme Court has ruled that Maui County Planning Commission erred in giving a Special Management Area permit to the developer of a 304-unit apartment complex in the Lahaina area. In its ruling, handed up November 5, the court determined that the Planning Commission should have required the developer to prepare a draft environmental assessment before it issued the SMA permit in February 1995.
